Terms of Service

By creating an account or completing a purchase on Polaris Marketplace ("the Marketplace", "we", "us", "PolarisDEV"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Marketplace.

These Terms constitute the complete agreement between you and PolarisDEV. We reserve the right to update them at any time. Material changes will be notified by email at least 14 days in advance. Continued use after the effective date constitutes acceptance.

Each product sold is a digital template comprising source code, assets, and documentation ("the Template").

Upon successful payment, PolarisDEV grants you a perpetual, non-exclusive, non-transferable, single-project license to use, modify, and deploy the Template for one (1) end project — personal or commercial.

"One project" means one deployed product or codebase. Re-using the same Template for a second unrelated project requires an additional license purchase.

Permitted: modify the Template for your project; deploy it commercially; use it in a client work-for-hire project; retain it in your private repository indefinitely.

Prohibited: redistribute the Template as a competing template, starter kit, or boilerplate — paid or free; sub-license or transfer your license; share download links with unlicensed individuals; build a product whose primary purpose is to compete directly with Polaris Marketplace.

Breach of these restrictions terminates your license immediately and may result in account suspension and legal proceedings.

The Creator plan is a recurring subscription giving access to all current and future templates listed on the Marketplace during the active subscription period.

Billing is monthly or annual depending on the option selected at checkout. The subscription renews automatically at the end of each billing period unless cancelled before the renewal date.

To cancel, use the billing portal accessible from your dashboard ("Manage subscription"). Cancellation takes effect at the end of the current billing period; access continues until then.

PolarisDEV reserves the right to modify subscription pricing with at least 30 days written notice. You may cancel before the new price takes effect.

Templates downloaded during an active Creator subscription are yours to keep under the license terms of Section 2, even after cancellation.

Under Article L.221-18 of the French Consumer Code (transposing EU Directive 2011/83/EU), consumers have a 14-day right of withdrawal from the date of contract conclusion.

For individual template purchases: by proceeding to checkout and completing payment, you expressly request immediate delivery of the digital content and acknowledge that you thereby waive your right of withdrawal in accordance with Article L.221-28, 13° of the French Consumer Code, once the download link becomes available.

For the Creator subscription: you have 14 days from the subscription date to withdraw without giving reasons, unless you have already begun accessing template content, in which case the waiver above applies.

To exercise a withdrawal right (where applicable), contact [email protected] within the 14-day period with your order reference.

All prices are displayed in US Dollars (USD). As a French micro-enterprise under the franchise en base de TVA regime (Article 293 B of the French General Tax Code), PolarisDEV does not collect VAT from customers; no VAT is added at checkout.

Payments are processed by Stripe, Inc. Your payment details are collected and stored by Stripe; PolarisDEV never stores card numbers or CVV. By completing a purchase you also accept Stripe's Terms of Service.

Digital content is delivered immediately upon payment confirmation.

Without prejudice to your statutory rights under Section 5, PolarisDEV offers a voluntary refund in the following circumstances: (a) you request a refund within 14 days of purchase and have not yet downloaded the Template; or (b) the Template contains a critical technical defect that we are unable to resolve within 7 business days of a written report.

Refund requests must be sent to [email protected] with your order reference. Approved refunds are processed within 5–10 business days to the original payment method.

If you are a consumer (purchasing for non-professional purposes), French statutory guarantees apply regardless of any other provision in these Terms:

Guarantee of conformity (Articles L.217-3 et seq. of the French Consumer Code): digital content must conform to the contract at the time of delivery. In the event of non-conformity, you are entitled to bring it into conformity or, where that is impossible or cannot be done within a reasonable time, to a price reduction or full refund.

Guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code): if the Template contains a hidden defect that makes it unfit for its intended purpose, you may return it and obtain a refund.

These statutory guarantees supplement and do not replace any commercial warranty offered.

Individual template licenses include all future updates to the purchased Template at no additional cost.

All Templates are the intellectual property of Jean-Luc Oudart-Sintes / PolarisDEV and are protected by French and international copyright law. A purchase grants usage rights as defined in Section 2, not ownership or copyright transfer.

Third-party libraries included in Templates are subject to their respective open-source licenses, documented in each Template's LICENSE file.

To the extent permitted by applicable law (and without affecting statutory consumer rights), Templates are provided without warranty of merchantability or fitness for a particular purpose.

PolarisDEV's total liability for any claim shall not exceed the amount paid for the Template or subscription giving rise to the claim. We are not liable for indirect, incidental, or consequential damages.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be limited by law.

In the event of a dispute that cannot be resolved by contacting us directly at [email protected], you may as a consumer refer the matter to a certified consumer mediator free of charge, in accordance with Articles L.612-1 et seq. of the French Consumer Code.

These Terms are governed by French law. Any dispute not resolved by mediation shall be subject to the jurisdiction of the competent French courts.

EU consumers retain the right to bring proceedings before the courts of their country of habitual residence under Article 18 of EU Regulation 1215/2012.
